Important: SafeChair is an intermediary platform under Section 79 of the Information Technology Act, 2000 (India). SafeChair does not endorse or verify user-submitted content. Users are solely responsible for the stories and comments they post. Content that is false, defamatory, or identifies private individuals by name is strictly prohibited and may expose the author to legal liability.

1. About SafeChair

SafeChair is an anonymous peer-support platform that allows professionals to share experiences of workplace sexual harassment. SafeChair operates as an "intermediary" as defined under Section 79 of the Information Technology Act, 2000 (India) and complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. SafeChair does not create, edit, or endorse user-generated content. All content posted on the platform is the sole responsibility of the user who posted it.

2. Eligibility

You must be at least 16 years of age to use SafeChair. By creating an account, you confirm that: • You are 16 years of age or older. • You have the legal capacity to enter into these Terms. • You are not barred from using the platform under any applicable law.

3. Permitted Use

SafeChair may be used to: • Share genuine, first-hand experiences of workplace sexual harassment. • Support other users by engaging with their stories respectfully. • Comment on posts with empathy and constructive engagement. Your content must be based on your honest, first-hand experience. SafeChair is not a platform for speculation, second-hand accounts, or fabricated content.

4. Prohibited Content

You may NOT post content that: • Is false, fabricated, or deliberately misleading. • Names or identifies specific private individuals (naming companies and job roles is permitted; naming individual employees by their real name is not). • Constitutes defamation under the Indian Penal Code (IPC Section 499) or any applicable law. • Contains sexually explicit material, graphic violence, or hate speech. • Harasses, threatens, or intimidates any person. • Discloses another person's private or confidential information without consent. • Attempts to identify, de-anonymise, or expose another SafeChair user. • Violates any applicable law or regulation. Violation of these prohibitions may result in immediate content removal and account termination, and may expose you to civil or criminal liability under applicable law.

5. Anonymity

SafeChair is designed to protect your anonymity. Your real name, email address, and employer are never shown to any other user. You agree to: • Not attempt to reveal or identify other users on this platform. • Not use information from this platform to identify, contact, or harm any other user. • Not attempt to circumvent the anonymity protections of the platform. Any attempt to de-anonymise users will result in immediate account termination and may be reported to law enforcement. Important: While SafeChair protects your anonymity by design, we cannot guarantee absolute anonymity under Indian law. In response to a valid court order, we may be legally required to disclose account registration data. See our Privacy Policy for full details.

6. Content Ownership and Licence

You retain ownership of the content you post on SafeChair. By posting content, you grant SafeChair a non-exclusive, royalty-free, worldwide licence to display, distribute, and store your content for the purpose of operating the platform. You also confirm that: • You have the right to post this content. • Your content does not infringe any third-party intellectual property, privacy, or other rights. • Your content complies with these Terms and all applicable laws.

7. Moderation and Content Removal

SafeChair reserves the right to remove any content that, in our reasonable judgment, violates these Terms, applicable law, or is the subject of a valid legal complaint. Content may be removed: • Following review of a user complaint submitted through our grievance process. • Upon receipt of a valid court order or government direction. • At our discretion if content poses a legal risk to the platform or other users. Removal of content does not imply admission of wrongdoing by SafeChair.

8. Grievance Mechanism (IT Rules 2021 — Mandatory)

In compliance with the IT Rules 2021, SafeChair has appointed a Grievance Officer: Name: Tushar Naik Email: tusharnaik16@gmail.com Any user or affected party may raise a complaint regarding: • Content posted on the platform. • Use of personal data. • Violations of these Terms. Process: • Acknowledgement within 24 hours of receiving a complaint. • Resolution within 15 days of receipt. • Content that is sexually explicit without consent, or that exposes private personal information, will be addressed within 24 hours. To file a complaint, email the Grievance Officer with: (a) a description of the content at issue, (b) the URL of the content, and (c) the nature of your complaint.

9. Government and Court Orders

SafeChair complies with valid legal orders from Indian courts and government authorities in accordance with the Information Technology Act, 2000 and IT Rules 2021. • Content subject to a valid court or government order will be removed within 36 hours. • SafeChair will preserve relevant records as required by law. • SafeChair will not comply with informal or unlawful requests. • Where legally permitted, SafeChair will notify affected users of orders received.

10. Disclaimer of Liability — Intermediary Status

SafeChair operates as an intermediary under Section 79 of the Information Technology Act, 2000. SafeChair: • Does not initiate, select, or modify user-generated content. • Is not the publisher or author of any content posted by users. • Does not endorse, verify, or guarantee the accuracy of user content. • Is not liable for any content posted by users, subject to compliance with applicable law. Users are solely responsible for the content they post and any consequences arising from that content, including civil or criminal liability under IPC Section 499 (Defamation) or any other applicable provision.

11. No Professional Advice

Nothing on SafeChair constitutes legal, medical, psychological, or professional advice of any kind. SafeChair is a peer support platform only. If you have experienced workplace harassment, we strongly encourage you to: • Consult a qualified employment lawyer. • Contact the Internal Complaints Committee (ICC) at your workplace under the POSH Act, 2013 (India). • Reach out to the National Commission for Women (NCW) or a relevant state commission. • Seek professional mental health support if needed.

12. Account Termination

SafeChair reserves the right to suspend or permanently terminate any account that: • Violates these Terms of Service. • Posts content that is the subject of a valid legal complaint. • Engages in behaviour that is harmful to other users or the platform. • Attempts to circumvent platform security or anonymity protections. You may also delete your account at any time. Upon deletion, your email and credentials are permanently removed. Your posts remain attributed to "Deleted User."

13. Limitation of Liability

To the maximum extent permitted by applicable law, SafeChair and its operators shall not be liable for: • Any indirect, incidental, or consequential damages arising from use of the platform. • Content posted by other users. • Loss of data, reputation, or business opportunity. • Any harm resulting from reliance on content posted on the platform. SafeChair's total liability in any matter arising from these Terms shall not exceed the amount paid by you to SafeChair in the 12 months preceding the claim (which, for free users, is zero).

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date. Continued use of SafeChair after updated Terms are posted constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the use of SafeChair shall be subject to the exclusive jurisdiction of the competent courts of India.
